Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This regulation was not met as evidenced by Based on written UIR and Director statement, an unusual incident occured on 2/2/26 which was not reported to the department until 5/21/26 which poses a risk to the health, safety, and personal rights of children in care.
No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This regulation was not met as evidenced by Based on camera footage and Director statement, a child was released to the playground by S1 where no staff were present and was alone without supervision for two and a half minutes which poses a potenetial risk to the health, safety, or personal rights of children in care.
Child's Medical Assessments — Based on record review, two children's files (C2 and C5) did not contain medical assessments which poses a potential health, safety or personal rights risk to persons in care.
Immunizations — Based on record review, two children's files (C3 and C5) did not contain complete immunization records which poses a potential health, safety or personal rights risk to persons in care.
Plan of Operation — Based on observation, children were playing in the outdoor area that the facility had requested to approve for use but had not yet been approved by the department which poses a potential threat to the health, safety, and personal rights of children in care.

Supervision shall include visual observation. — Based on an Unusual Incident Report submitted by the facility and interviews from staff, a child (C1), had snuck inside the classroom without being seen by staff which poses a potential health, safety or personal rights risk to persons in care.
Written directives for drinking water lead testing — On 12/27/24, licensee failed to maintain a lead value at or below the Action Level for water lead testing resulting with values of 5.5 ppb or greater for faucet "B". Water testing results identified with Action Level Exceedance as defined in WD section 101700.3. are not deemed safe to drink. This is a potential health and safety risk to children in care.
Personal Rights — Based on interviews and record review, C1 was restrained in the preschool bathroom on 11/16/23 by A9 and on 2/14/24 by A8. This poses a potential health, safety and personal rights risk to children in care.
Reporting Requirements — Based on interview and record review staff who directly observed or later became aware of the incidents did not report it to the Department and did not submit a written incident report as required. This poses a potential health, safety or personal rights risk to persons in care.
