Personal Rights — Based on observation, the licensee did not comply with the section cited above in that, LPAs observed Staff 2 (S2) yell at children and yank a child's arm while assisting them in the restroom, which poses an immediate health, safety or personal rights risk to persons in care.

Responsibility for Providing Care and Supervision — Based on observation, the licensee did not comply with the section cited above in that, LPAs observed two children going into the outdoor restroom without the supervision of staff, which poses an immediate health, safety or personal rights risk to persons in care.

Teacher-Child Ratio — Based on observation, interview, and record review, the licensee did not comply with the section cited above in that 2 staff members did not have education verfication to meet qualifications, which poses an immediate health, safety or personal rights risk to persons in care.

Teacher-Child Ratio — Based on staff’s interview, S2 disclosed being left alone with 14 children. This poses an immediate health and safety risk to the children in care.

Responsibility for Providing Care and Supervision — Based on staff’s interview, S1 admitted to being the only staff present at the facility from opening until 8:30am for both the infants and preschoolers. S3 disclosed witnessing S1 left the preschoolers playing outside while S1 was in the infant room with the door opened. This poses an immediate health and safety risk to the children in care.

Teacher Qualifications and Duties — Based on staff’s interview and record review, S3 only has 3 ECE units and was left alone supervising children. This poses an immediate health and safety risk to the children in care.

Limitations on Capacity and Ambulatory Status — Based on staff’s interview, S3 stated S3 currently has two children under 2 yrs. old with the young preschoolers. S2 and S3 stated, they combine the (preschool) children with the infants at the end of the day into the infant classroom. This poses an immediate health and safety risk to the children in care.

Criminal Record Clearance — Teacher Nicole Lockmer began employment at the facilty in May 2023 and has been present at the facility without being associated to the facility. In Nicole's file, there was an imcomplete Live Scan form and Nicole needed the LIC 9182- Clearance transfer request.

Food Service — Based on observation and interview, the licensee did not comply with the section cited above in that, there was one gallon of expired milk in the preschool kitchen fridge, which poses a potential health, safety or personal rights risk to persons in care.

Outdoor Activity Space — Based on observation, the licensee did not comply with the section cited above in that, there was a hole in the cushioning material of the playground surface surrounding the climbing the structure, which poses a potential health, safety or personal rights risk to persons in care.

Sign In and Sign Out — Based on observation and file review, the Facility Representative did not comply with the section cited above in that, 3 out of 10 children present at the time of LPA and LPM's arrival were not signed in, which poses a potential health, safety or personal rights risk to persons in care.

Current roster of children — Based on observation and file review, the Facility Representative did not comply with the section cited above in that, Facility Representative did not ensure that the facility roster was up to date, which poses a potential health, safety or personal rights risk to persons in care.

Personnel Records — Based on record review, the licensee did not comply with the section cited above in that, Staff 1 (S1) did not have a complete personnel record on file, which poses a potential health, safety, or personal rights risk to persons in care.

Current roster of children — Based on observation, interview, and record review, the licensee did not comply with the section cited above in that, licensee did not have a current roster of children enrolled, which poses a potential health, safety or personal rights risk to persons in care.

Buildings and Grounds — Based on observation and interview, the licensee did not comply with the section cited above in that, storage cabinet for Raid spray can was not locked, which poses a potential health, safety, or personal rights risk to persons in care.

Disaster and Mass Casualty Plan — Based on observation, interview, and record review, the licensee did not comply with the section cited above in that, facility did not complete an emergency disaster drill since 8/30/24, which poses a potential health, safety or personal rights risk to persons in care.

Buildings and Grounds — Based on observation, the licensee did not comply with the section cited above in that, there was a broken tricycle in the play yard, which poses a potential health, safety or personal rights risk to persons in care.

Personnel Records — Based on record review, the licensee did not comply with the section cited above in that, Staff 1 (S1) did not have a complete personnel record, which poses a potential health, safety or personal rights risk to persons in care.

Sign In and Sign Out — Based on record review, the licensee did not comply with the section cited above in that, 2 out of 18 children were not signed in, which poses a potential health, safety or personal rights risk to persons in care.

Child's Records — Based on observation, interview, and record review, the licensee did not comply with the section cited above in that, 17 out of 17 children files reviewed were incomplete, which poses a potential health, safety or personal rights risk to persons in care.

Buildings and Grounds — Based on observation, the licensee did not comply with the section cited above in that, poisons were not stored in a locked area, which poses a potential health, safety or personal rights risk to persons in care.

Notice to parents that site visit reports are available — Based on record review, the licensee did not comply with the section cited above in that, 17 out of 17 children files did not have all required LIC 9224, which poses a potential health, safety or personal rights risk to persons in care.

Drinking water lead testing — Based on interview and record review, the licensee did not comply with the section cited above in that, facility did not complete lead testing, which poses/posed a potential health, safety or personal rights risk to persons in care.

Disaster and Mass Casualty Plan — Based on observation, interview, record review, the licensee did not comply with the section cited above in that, the director stated they have never conducted an emergency drill, which poses a potential health, safety or personal rights risk to persons in care.

Buildings and Grounds — Based on observation, the licensee did not comply with the section cited above in that the outdoor playground had items which were broken, which poses a potential health, safety or personal rights risk to persons in care.

Staff immunization requirements — Based on record review, the licensee did not comply with the section cited above in that, 2 staff did not have current immunization record on file, which poses a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on record review, the licensee did not comply with the section cited above in that 1 staff member did not have a health screening report on file, which poses a potential health, safety or personal rights risk to persons in care.

Food Service — Based on observation, the licensee did not comply with the section cited above in that, one can of pesticide was kept in the same cabinet as kitchen equipment, which poses/posed a potential health, safety or personal rights risk to persons in care.

101217 Personnel Records: The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. This requirement was not met by: 6 out of 6 staff did not have complete files.

101221(a) Child's Records: A separate, complete and current record for each child is maintained in the child care center. This requirement was not met by: 5 out of 5 children's records were incomplete.
