102417 Operation of a Family Child Care Home (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. This requirement was not met by: Based on interviews and medical documentation, the licensee did not comply with the section cited above due to Licensee negligence in allowing C1 to be barefooted in hot surface. Medical documentation indicated the attending physician diagnosed C1 with Second-degree burns on the plantar surface of both feet, on the pads of 2nd and 3rd toes as well as overlying distal metatarsals, which poses an immediate health, safety or personal rights risk to persons in care.
1597.58 HSC (f)(1) For a violation that the Department determines… or resulted in serious injury, as defined in Section 1596.8865, to a child, the civil penalty shall be assessed a follow: Two thousand ($2000) for a Large Family Child Care Home … in section 1597.44. The requirement was not meet evidence by: Based on the IB/LPA investigation on interviews conducted and medical reports in C1 sustaining a second-degree burn on the bottom of both feet while in care that may have been preventable.
