Responsibility for Providing Care and Supervision — Based on interviews and witness documentation, it is determined that in March 2024 a staff member left a child outside in the facility playground, unattended, and without care, supervision and required visual observation, for a period of approximately 2 to 5 minutes, which is an immediate health, safety and personal rights risk to children in care .

Reporting Requirements — Based on record review and information gathered during another matter, the facility did not report to the Department an injury incident on 10/10/24 to a daycare child that required medical attention, which poses a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Per investigation interviews, facility documentation, and director witness, teacher aides supervised children without the training or experience to effectively meet child care needs. This is a potential health, safety and personal rights risk to children in care.

Buildings and Grounds — Based on LPA observation, investigation interviews, and visual documentation, facility furniture (bookshelves) was not secure and presented a hazard, which poses a potential health, safety or personal rights risk to persons in care.

Admission Agreements — Based on information obtained during interviews and record review, the Licensee failed to comply with the regulation above as child C1 was terminated/disenrolled in violation of admission agreement, which poses a potential health, safety or personal right risk to children in care.

Teacher-Child Ratio — Based upon interviews and witness documentation, on multiple occasions a teacher and an aide (without ECE units/experience) supervised more than 15 children, which is a potential health, safety and personal rights risk to children in care.

Teacher Aide Qualifications and Duties — Based on interviews, facility documentation, and direct witness, unqualified staff (aides without ECE credits) supervised children alone, without the direct supervision of a teacher, when children were awake. This is a potential hazard to the health and safety of children in care.

Responsibility for Providing Care and Supervision — Based on information gathered during investigation interviews it is determined that staff did not maintain care and supervision outdoors, as witnesses observed staff -- during children’s afternoon activity on the playground -- using cell phones for personal use. This poses a potential risk to the health and safety of children in care.

Reporting Requirements — Based on record review and information gathered during another matter, the facility did not report to the Department an incident in March 2024 involving staff's failure to provide adequate supervision, when a daycare child was left outside unattended.
