Personal Rights — Based on LPA's observation, the licensee used corporal punishment by spanking a child on the bottom with her hand for not listening to her. This poses an immediate risk to the health, safety, or personal rights of children in care.

All licensees shall ensure the inaccessibility of pools... Fences shall be at least five feet high... gates shall swing away from the pool, self-close and have a self-latching device... This requirement has not been met as eviidenced by: Based on LPA observation, the mesh pool gate self-closes; however, it does not self-latch. Licensee has a lock and alarm installed on the sliding door in the inaccessible dining room.

Additionally, the pool safety hook has not been assembled. This poses a potential risk to the health and safety of the children in care.

Based on LPA observation and Licensee interview, there were eight children present, with only one child being school age as well as one infant. Family home — in-ground pool drowning prevention requirements — Based on LPA observation, the Licensee does not have an ASTM F134623 pool cover OR ASTM 2208 pool safety alarm for the swimming pool and jacuzzi. Licensee also has a pool safety hook that is not within regulation.
Family home — home free of safety hazards — Based on LPAs observation, medications, alcoholic beverages, cleaning wipes, expired food & excessive clutter in areas not used for the daycare, but are accessible to the children in care.
Infant Safe Sleep — Based on LPA observation, Child #1 had toys surrounding them in the play yard while asleep. This poses a potential risk to the health, safety, or personal rights of children in care.

Child's Records — During the record review of children’s files, Licensee revealed that Child #2 and #3 did not have their own files. This poses a potential risk to the health, safety, or personal rights of children in care.
Staff immunization — influenza, pertussis and measles — Based on record review and interview with Licensee, Staff #2 did not have documentation of immunizations on file. This poses a potential risk to the health, safety, or personal rights of children in care.
Infant Safe Sleep — During record review, LPA observed infant file did not contain a LIC9227 form. This poses a potential risk to the health, safety, or personal rights of children in care.
Personal Rights — Based on observation, the licensee did not ensure children in care were not subject to observing an inappropriate crime documentary discussing graphic topics and scenes which may frighten, traumatize and/or cause distress a child in care. This poses a potential health, safety or personal rights risk to persons in care.
