Limitations on Capacity and Ambulatory Status — Based on observation and interview, the licensee did not comply with the section cited above by having 2 school aged children present commingled with the preschool aged children outside of the first and last hour which poses an immediate health, safety or personal rights risk to persons in care.

Child Care Center Director Qualifications and Duties — Based on observation and record review, the facility did not comply with the section cited above as the facility operated for part of a day without a qualified director present, which poses an immediate health, safety or personal rights risk to persons in care.

Teacher Aide Qualifications and Duties — Based on observation and record review, the facility did not comply with the section cited above as staff without teacher qualifications supervised children alone and acted as substitute director, which poses an immediate health, safety or personal rights risk to persons in care.

Health and Safety Code Section 1596.885(c): Conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of this state. Based on and record review, the facility did not comply with the section cited above by falsifying personnel records to indicate staff fully qualified as a teacher, which poses an immediate health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on interview and record review, the licensee did not comply with the section cited above by transporting children without a valid CPR and attending to the facility without a staff member with valid CPR present which poses/posed a potential health, safety or personal rights risk to persons in care.

Teacher Qualifications and Duties — Based on interview the facility did not comply with the above regulation as staff member file was missing transcripts from school accredited per Title 22 which poses a Health, Safety, or Personal Rights risk to persons in care.

(a) Upon presentation of identification, the responsible parent or guardian of a child receiving services in a child day care facility has the right to enter and inspect the facility without advance notice during the normal operating hours of the facility. — witness statements and document reviews showing staff required one or more parents to provide advance notice prior to arriving at the facility during normal operating hours and kept one or more parents waiting for staff to let them in. This constitutes a potential health, safety, and/or personal rights risk to children in care.
