The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons. This was not met as evidenced by: Staff was observed bending down and making contact with the child’s upper left arm using her hand. Upon making contact, the child’s upper body is observed moving, in response to the impact from the hit of the adult staff. This poses an immediate health and safety risk to children in care.

Infant Care Teacher Qualifications and Duties — During a review of staff files,LPA did not see required units in infant care for S1 and S2. Based on record review, the center did not meet the above

Responsibility for Providing Care and Supervision for Infants — interview(s) and document review. A child suffered cuts and abrasions while in care however, only assumptions were made as to what may have happened but, all staff that were providing care and supervision to the child, on the day in question, did not know what happened.

Personnel Requirements — Based on record review, the licensee did not comply with the section cited above. Staff 1 most recent tuberculosis test was given in 2001, proof of tuberculosis current test results or proof of chest x-ray results are not available for review during this visit, which poses a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above, staff 1 Mandated Reporter Child Care Providers Training (AB1207) was completed on 08/18/2023 and there is not a current Mandated Reporter Child Care Providers Training (AB1207) on file, which poses a potential health, safety or personal rights risk to persons in care.

Modifications to Infant Needs and Services Plan — Based on record review, the licensee did not comply with the section cited above. Child 1, 2, and 5 does not have a current Needs and Services Plan available for review during this visit, which poses a potential health, safety or personal rights risk to persons in care.

Responsibility for Providing Care and Supervision for Infants — Based on record review and interview, the licensee did not comply with the section cited above. Child 1, 2, 5, and 6 does not have an Infant Sleep Log that documents the time of each 15-minute check at the time of the visit. Per Directors own admission, they were not aware the 15-minute check should be documented and maintained for infants 12 months - 24 months. This poses/posed a potential health, safety or personal rights risk to persons in care.

Indoor Activity Space for Infants — Based on observation and interview, the licensee did not comply with the section cited above. Based on previous visit(s), photos taken, today's observations, and staff disclosure, the partitions that separate the sleeping area from the activity space, have been moved. This was done without prior approval of the Department. This poses/posed a potential health, safety or personal rights risk to persons in care.

Infant Care Center Fixtures, Furniture, Equipment, and Supplies — Based on observation, the licensee did not comply with the section cited above. During the tour of the classrooms, LPA observed changing tables/pad NOT within arms reach of a sink. This poses/posed a potential health, safety or personal rights risk to persons in care.

Infant Care Activities — Based on observation, the licensee did not comply with the section cited above. LPA observed two infants in sleep sacks, sleeping in their assigned cribs. Although not swaddled, sacks still restricted the movement. This poses/posed a potential health, safety or personal rights risk to persons in care.

Staff immunization requirements — Based on record review, the licensee did not comply with the section cited above. In reviewing staff records, it was determined that Staff #1, #2, and #4, did not have proof of the required immunizations on file. This poses/posed a potential health, safety or personal rights risk to persons in care.

Personnel Requirements — Based on record review, the licensee did not comply with the section cited above. In reviewing staff files, LPA determined that Staff #1 and #6, did not have the required health screening/TB test on file. This poses/posed a potential health, safety or personal rights risk to persons in care.

Teacher Qualifications and Duties — Based on record review, the licensee did not comply with the section cited above. In reviewing staff files, LPA did not observe a copy of required transcripts, for Staff #1. This poses/posed a potential health, safety or personal rights risk to persons in care.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above. In reviewing staff records it was determined that Staff #1, #4 and Staff #7, did not have current proof of completion for the required training. This poses/posed a potential health, safety or personal rights risk to persons in care.

Modifications to Infant Needs and Services Plan — Based on record review, the licensee did not comply with the section cited above. In reviewing children files, LPA determined that several needs and services plan were not updated. This poses/posed a potential health, safety or personal rights risk to persons in care.

Indoor Activity Space for Infants — observation and measurement taken of the partitions being less than four feet high. This poses/posed a potential health, safety risk to the children in care.
