Criminal background check — Based on record review, the licensee did not comply with the section cited above. On 11/07/2023 at 12:30 PM, Licensing Program Analyst (LPA) Ka Vang arrived at the daycare home unannounced to conduct a required Annual Inspection and met S3, who she stated that she volunteers at the daycare home once or twice a week depending on if she is needed to assist with the daycare home. S3 stated that for today, 11/07/2023, S3 volunteer from 11:30 AM to 5:30 PM. S3 stated that she volunteers off and on at the daycare home for the past couple of months. During the arrival of LPA, S3 was supervising 7 children without the present of the licensee or an Assistant with a criminal record clearance or exemption. This poses an immediate health, safety, or personal rights risk to children in care.

(g): The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to: (8) Each family child care home shall have a current roster of children as specified in Health and Safety Code Section 1596.841. This requirement is not met as evidenced: During the inspection, LPA observed seven children were present in care. Licensee was not able to provide current daycare children roster for the children who enrolled in the daycare home. This poses as a potential risk to the health, safety, or personal rights of children in care.

Family home — home free of safety hazards — Based on observation, the licensee did not comply with the section cited above. LPA observed the home is a two-story home and it has a stair. The stair was not fenced or barricaded and there are daycare children who are under five-year-old. During the physical inspection of the backyard, LPA observed a large pile of unused woods that children have access to the large pile of woods. This poses a potential health, safety, or personal rights risk to children in care.

Family home — home free of safety hazards — Based on record review, the licensee did not comply with the section cited above. The licensee did not conduct a fire and disaster drills at least once every six months. This poses a potential health, safety, or personal rights risk to children in care.

Family home — children supervised at all times — During the unannounced inspection, Assistant Staff #2 (S2) and Volunteer Staff #3 (S3) were present with seven children. S2 stated that Licensee Staff #1 (S1) was not home as she was doing her internship with Visalia Unified School District in the beginning of school year 2023. S1 stated that she is interning Monday to Wednesday, 8:00 AM to 4:00 PM. Licensee temporary absences exceed 20 percent of the hours that the facility is providing care per day, therefore, this poses a potential health, safety, or personal rights risk to children in care.

Infant Safe Sleep — Based on record review, the licensee did not comply with the section cited above. Facility representative was not able to provide proof that facility representative check on Child #3 (C3) and Child #4 (C4) every 15 minutes when they were sleeping.

Mandated reporter training — Based on record review, the licensee did not comply with the section cited above. Record review indicated that S2 and S3 did not have current proof of the complete mandated reporter training. This poses a potential health, safety, or personal rights risk to children in care.
