(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain… This requirement is not met as evidenced of photos after an incident occurred where Child #1 (C1) sustained scratches from upper forearm when lifted from sitting position by a caregiver submitted by RP to the department. The director failed to ensure that the physical safety of children in care is not threatened. Per director, C1 remains enrolled in the Infant Center, and was in school attendance on 05/01/2023 during LPA initial 10-day visit.
(d)Upon the occurrence, during the operation of the child care center of any of the events… (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child This requirement is not met based on the interview with Infant Center Administrative Director, Elizabeth Marenco. Per director, a report (call/fax/or email) was not made to the department within the department’s next working day after an incident occurred on 04/26/2023 and where C1 sustained scratches from upper forearm when lifted from sitting position by a caregiver. This poses a potential risk to the health and safety, or personal rights of children in care.
