Personal Rights (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (4) To be free from corporal or unusual punishment, infliction of pain,... or other actions of a punitive nature... This was not met as evidenced by: Based on LPA interviews, two of four children stated L1 handled them in a rough manner and three of six parents stated their child was handled in a rouch manner which poses a potential risk to the health, safety, and personal rights of persons in care.
Family home — children supervised at all times — L1 is not ensuring children are supervised at all times while awake and crying in cribs in the bedroom, while sitting in their cubbies in the kitchen and having a curtain hang in the doorway blocking sight to the playroom which poses an immediate health, safety or personal rights risk to persons in care.
Personal Rights — L1 is placing children in cribs and cubbies as a way to calm down for 5-10 minutes as well as a place to wait for their guardians to pick them up which poses an immediate health, safety or personal rights risk to persons in care.
Infant Safe Sleep — Based on observation, the licensee did not comply with the section cited above in which one room did not have the door open while two infants C1 & C11 were sleeping inside, which poses an immediate health, safety or personal rights risk to persons in care.
Infant Safe Sleep — Based on observation, the licensee did not comply with the section cited above in which two room had doors completely closed with three infants C3 -C5 sleeping in them which poses an immediate health, safety or personal rights risk to persons in care.

Immunizations — Based on interview and record review, the licensee did not comply with the section cited above in that C1, C3 and C4's CDPH 286 forms were missing immunizations according to the immunization records provided in their files which poses/posed a potential health, safety or personal rights risk to persons in care.
(c)(1) A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation … (1) of subdivision (a) of Section 1596.893b. (2) Upon enrollment of a new child in a facility, the licensee shall provide to the parents or legal guardians of the newly enrolling child copies of any licensing report that the licensee has received during the prior 12-month period that documents any Type A citation ... Based on LPA observation, record review, and interview 4 of 6 parents stated they did not receive licensing reports documenting a Type A citation upon enrolling in L1's daycare which poses a potential risk to the health, safety, and personal rights of persons in care.
1. (e)Upon presenting identification, the parent or authorized representative of a child in care has the right to enter and inspect the family childcare home without advance notice during the family childcare home's normal operating hours. This was not met as evidenced by: Based on LPA interviews, 3 of 6 parents were not allowed entry into the daycare home during drop off and pick up which poses a potential risk to the health, safety, and personal rights of persons in care.
Personal Rights — Based on evidence received staff are not providing children with attention or comforting children which poses an immediate health, safety or personal rights risk to persons in care.
Family home — admission procedures and parent rights — Based on interviews staff do not allow parents entry into the facility at drop off or pick up which poses an immediate health, safety or personal rights risk to persons in care.
Family home — home free of safety hazards — Based on observation, the licensee did not comply with the section cited above in which the bathroom had disinfecting wipes on the sink which was accessible to children which poses/posed a potential health, safety or personal rights risk to persons in care.
Infant Safe Sleep — Based on observation, interview and record review, the licensee did not comply with the section cited above in which 2 children (C1 & C7) did not have up to date sleep logs available for review, which poses/posed a potential health, safety or personal rights risk to persons in care.
Staffing Ratio and Capacity — Based on observation and interview, the licensee did not comply with the section cited above. Upon LPA's arrival the Licensee was not home and the assistant was supervising 11 children alone for approximately 25 minutes, which poses/posed a potential health, safety or personal rights risk to persons in care.
Notice to parents that site visit reports are available — Based on statements which confirm L1 did not provide the full written report to all parents upon enrollement. This posed a potential health, safety and/or personal rights risk to the children in care.
Alterations to Existing Building or Grounds — Based on observation and interview, the licensee did not comply with the section cited above in which children are allowed to use the front yard as an area to play which poses/posed a potential health, safety or personal rights risk to persons in care.
