(e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). Based on the observation, the Licensee did not meet the above regulation which poses an immediate safety risk to the children in care. Upon arrival S1 was left alone providing Care and Supervision to 12 children. Aprroximately 10 minutes after LPAs arrival, S2 arrived.

(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility:(1) Obtain a California clearance or a criminal record exemption as required by the Department or Based on the record review & interview, the Licensee did not meet the above regulation which poses an immediate Health, Safety & Personal Rights risk to the children in care. During the inspection, it was disclosed S1 and S2 work at the facility. The Licensee confirmed S1 and S2 work at the facility. S1
(2) Request a transfer of a criminal record clearance as specified in Section 102370(j)... Based on the record review & interview, the Licensee did not meet the above regulation poses an immediate Health, Saftey & Personal rights risk to the children in care. During the inspection, it was disclosed S3 works at the facility. During the Licensee’s confirmation of S1 and S2 working at the facility, he stated S3 also works at the facility. Each family child care home shall have a current roster of children as specified in Health and Safety Code Section 1596.841. Based on the record review & interview, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. During the review of the LIC 9040 Child Care Facility Roster, the LPA determined there were seven children present who were not on the LIC 9040.
