Responsibility for Providing Care & Supervision: (a) The licensee shall provide care & supervision...(1) No child(ren) shall be left without the supervision of a teacher... Supervision shall include visual observation. This regulation was not met as evidenced by: Based on evidence gathered, on 12/11/2025 a child was left unsupervised on a playground for an unknown time frame, until licensee representatives were notified, which is an immediate risk to the health and safety of children in care.

Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse... This regulation was not met as evidenced by: Based on evidence gathered a subject staff was observed rough handling a subject child inappropriately on 12/11/2025, causing the child to cry, which is an immediate risk to the health and safety of children in care.

101227 Food Services:(a)...child care centers providing meals to children, the following shall apply: (7) Modified diets prescribed by a child's physician; (B) A child shall not be served any food to which the child's record indicates he/she has an allergy. This regulation was not met as evidenced by: Based on interview, record review, observation & by the licensee's own admission, on 10/10/2025 emergency medical services were required for a subject child due to the licensee providing a known, restricted food item during mealtime, which is an immediate risk to the health & safety of children in care.

Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1)...a report shall be made..within the Department's next working day... within seven days following the occurrence of such event. This regulation was not met as evidenced by: Based on information gathered the licensee failed to report allegations for personal rights, absence of supervision, change in director, and/or contact with local law enforcement by admission, which took place on 12/11/2025; which is a potential risk to the health and safety of children in care.

101212 Reporting Requirements: (f) The items specified in (d)(1)(A) through (H) above shall also be reported to the child's authorized representative. This regulation was not met as evidenced by: Based on review of children's records, the licensee was unable to provide proof of notification to authorized representatives regarding allegations of rough handling & a child was left unsupervised on a playground on 12/11/2025, which is a potential risk to the health and safety of children in care.

Teacher Aide Qualifications and Duties — Based on observation, Interview, record review, by admission the licensee did not comply with the section cited above in the LPA observed teacher's assistants supervising children alone in the Toddler option program which posesd a potential health, safety or personal rights risk to persons in care.

(2) A ratio of six children to each teacher shall be maintained for all children in attendance in the toddler component. An aide who is participating in on-the-job training may be substituted for a teacher when directly supervised by a fully qualified teacher. — Based on observation, interview, record review, the licensee did not comply with the section cited above in the facility does not have a fully qualified teacher assigned to the toddler option program who meets the educational requirements, which poses a potential health, safety or personal rights risk to persons in care.
